Donald Trump vowed to appeal his D.C. trial date, which is set for January and February 2021. However, his appeal is likely to be fruitless for several reasons.
First, Appeals don’t delay the underlying trial, they just delay the ruling from being issued. Therefore, even if Trump did win his appeal, the trial would still occur on the scheduled timeline.
Second, Trump’s odds of winning his appeal are low because the judge issuing the date is an appellate court judge himself. This means that the judge is well-versed in the law and would be unlikely to make a ruling that could be easily overturned on appeal.
Finally, it is highly unlikely that any appeal would be heard before the trial date. Appeals can take months, if not longer, to be heard, and this would obviously not help Trump’s cause if the trial began before the appeal was heard.
