Jack Smith, an attorney representing the state of Michigan in its election lawsuit against President Donald Trump and his election team, has asked a federal judge to block Trump from making “partisan political attacks” during the trial.
In a court filing, Smith noted that Trump has already made “false claims of widespread voter fraud,” and that he “has continued to stoke doubts about the legitimacy of the November 2020 election in speeches, social media posts, and broadcast interviews.”
Furthermore, Smith argued that Trump should be barred from making “partisan political attacks,” citing case law which holds that courtroom proceedings should be used to resolve legal issues, not to advance political opinions.
“Political statements in court proceedings create an appearance of bias and undermine the public’s confidence in the courts,” argued Smith. He further noted that it would be “unfair and prejudicial” to allow the president to use the proceedings to further his political agenda.
