In January 2020, the U.S. Justice Department announced that engine maker Cummins Inc. had agreed to pay $1.5 billion in civil penalties related to alleged violations of the Clean Air Act. This is believed to be the largest Clean Air Act penalty ever imposed.
The Justice Department alleged that Cummins had sold more than 500,000 trucks and tank engines with emissions-cheating defeat devices that allowed the vehicles to exceed emissions limits for nitrogen oxide (NOx). Cummins agreed to pay a $300 million criminal penalty, $700 million in civil penalties to resolve allegations of air pollution, and $500 million to offset environmental damage. In addition, Cummins and its subsidiaries will take steps to reduce emissions of NOx to mitigate the emissions of excess pollution and ensure compliance with the Clean Air Act.
