Disney has dropped all but its free speech claim in its lawsuit against Florida Governor Ron DeSantis for political retaliation. The company was claiming that DeSantis’ actions—in which he vetoed $800,000 in tax incentives—and public statements about the company following its decision to pause reopening its Florida theme parks until receiving approval by the state to reopen—violated its First Amendment civil rights.
After an Orange County judge refused to dismiss the case, Disney amended its claim, dropping its remaining claims, including defamation, tortious interference, and violations of Florida law. The amended claim now focuses on the First Amendment claim, alleging that DeSantis and state officials used “political retaliatory tactics” against Disney to punish it for exercising its right to free speech.
The case is ongoing, with the parties currently exchanging court-ordered discovery. A hearing to consider the defendants’ motion to dismiss the free speech claim is slated for July 2021.
