Russian court bailiffs are set to get new powers to seize cryptocurrencies as well as central bank digital currencies (CBDC). As per a document released by the Russian Ministry of Justice (MOJ), the new rules will become effective on January 1, 2021. The new regulations would also allow court bailiffs to demand all the necessary information needed to identify cryptocurrency assets in case they are imposed by a ruling of a court. The document states that if court bailiffs suspect that “digital rights (including digital money, tokens, digital currencies, and cryptocurrency) are associated with the debtor, they can require the debtor and other persons carrying out transactions with digital money or tokens to provide the documents necessary for obtaining information about their volume, sources of origin, and place of storage if any”. Furthermore, the MOJ has also clarified that the court bailiffs will also be able to access information from cryptocurrency exchanges, custodians, and wallets. This will enable the bailiffs to seize digital rights to repay any arrears from legal entities and citizens of the Russian Federation.
